Abbott paid $385m over formula allegations. What was actually proved?

THE CHOP: SERIOUS ALLEGATIONS; LIABILITY NOT DETERMINED

The settlement is real and the government allegations are serious. But “Abbott paid because contaminated formula killed babies” goes further than the settlement establishes.

What appears true

The US Justice Department announced a $384,999,040 civil settlement resolving allegations involving powdered infant formula and nutritional therapy products made between 2018 and 2022. The government alleged manufacturing conditions created an unacceptable contamination risk and that products supplied through government programs failed requirements.

What that does not prove

The Justice Department explicitly says the resolved claims are allegations and there has been no determination of liability. The settlement itself is not proof that distributed formula caused particular infant infections or deaths.

Why it matters

Baby-formula stories spread fast because the stakes are enormous. That makes the distinction between a manufacturing-risk allegation, a recall, a detected organism and proven causation especially important.

The Chop angle

“$385 million sounds like a confession. It isn’t one.” Lay out the government’s allegations in full, then draw a hard line around what the settlement does and does not establish.
